The following terms and conditions govern your use of Fastrek.com and include the use of all Fastrek Express Inc. services unless different trading conditions are agreed to in writing and signed acceptance of such differences are on file with Fastrek Express Inc. at it’s corporate office. In the event there are different trading conditions on file at Fastrek Express’s corporate office the differences as they appear on those trading conditions only apply to those differences and all other terms and conditions listed following apply. Your viewing or use of this site will constitute your agreement, on behalf of yourself and the entity you represent, to all the terms and conditions provided below.
Fasrek Express Inc. may make future changes or modifications to such terms and conditions at any time without notice, and your subsequent viewing or use of Fastrek.com will constitute your agreement to the changes and modifications. There may be additional terms and conditions provided throughout Fastrek.com governing your use of particular functions, features, information and applications available through Fastrek.com.
- The following trading conditions supersede all conditions on any and all bills of lading presented to Fastrek Express be it a customer's suppliers or the customer themselves unless they contravene the governing Canadian law whereby Canadian law will preside over that conflict. If such conflict exists only that clause will be overruled and all other clauses will prevail.
- Rates include pickup and single destination delivery and apply to prepaid outbound and collect inbound shipments and to lanes and services quoted. All other lanes and services utilized will be subject to published tariff.
- Rates do not include applicable taxes, fuel, AIS or NAV CAN surcharges.
- If no service is indicated on the customer waybill Fastrek Express Inc. will move it on Regular Ground Service.
- Payment Terms: Freight charges are to be paid within 30 days from the date of shipping. Invoices outstanding over 30 days will be subject to a 2 % surcharge at the first of each month. The customer agrees that in the event Fastrek Express Inc. incurs any expenses collecting past due invoices that the customer will reimburse all legal, collections or other expenses incurred during this process.
- C.O.D. and Advanced Charges: All C.O.D. and Advance Charge shipments accepted by Fastrek will be subject to an additional charge of 6 % of the customer's amount to be collected and freight charges if applicable with a minimum of $30.00 per C.O.D. or Advance Charge shipment.
- Valuation Charges: Limitation of liability for loss or damage shall be limited to the lesser of $4.41 / kg. ($2.00 per pound) based on the actual weight of the shipment or the value of the goods at the place and time of shipment including the freight and other charges if paid. If a value is declared an insurance charge of $2.50 per $100.00 or part thereof shall apply on the difference over $2.00 per pound or the free allowance whichever is less with a minimum charge of $9.50 per shipment. The Forwarder's liability will not exceed the shipper's original cost of the product. Fastrek Express Inc. does not offer insurance for glass, ceramics, perishables, works of art, mirrors, gems jewelry, negotiable funds, precious metals or live plants. Nor are we liable for any defect or inherent vice in the goods an act of default of the consignor, owner or consignee authority of law, quarantine, difference in weights of grain, seed or other commodities caused by natural shrinkage. Claims for loss or damage must be clearly identified on the delivery bill and / or in the event of non delivery / the claimant must notify Fastrek Express Inc. in writing of the intent to claim within 15 days of / the expected time of / delivery. The Forwarder retains the privilege to inspect the shipment its container(s) and packaging material after receipt of such notice at a time convenient to the Forwarder. Fastrek Express Inc. has the privilege to deduct the customers salvage value from any claims. Freight and insurance charges of the original shipment are not to be considered as part of a claim and must be paid prior to any claim being processed.
- Customs Clearance, duties and taxes: these charges if applicable are to be paid directly to the customs broker.
In-Bond Handling Fee: Ground shipments that move In-Bond or can not be cleared at the Canadian-US border crossing will be subject to an In-Bond Handling Fee of $50.00 up to 1000 pounds plus $0.04 per pound thereafter.
- Accessorial Charges:
Appointments: an appointment fee will apply if it is required and it was not clearly identified on the shipper's waybill.
Redirect: shipments requiring delivery to an address different than the address on the original waybill tendered.
Redelivery: if the consignee cannot accept the shipment as scheduled a redelivery charge will apply.
Inside Delivery: shipments over 100 Lbs requiring a delivery into an office tower or a mall add $15.00 plus $0.05 per Lbs.
Waybill Changes: changes to handling instructions or service required made after the shipment is picked up add $5.00.
Documents (Proof of Delivery, Bill of Lading Copies): when requested will be supplied at a rate of $10.00 per shipment.
Residential or Storage Unit Pickup or Delivery: add $35.00 + $0.05 per pound.
Storage: shipments held over 1 day add 1 cent per pound per day, minimum of $5.00 per day.
Totes: Provide skids with cardboard sides add $25.00 per skid.
Skid & Shrink Wrap: Provide a skid and shrink wrap will be charged at $10.00 per skid.
Blanket Wrap: Three Ply Paper Blankets are $4.50 each and Cloth Blanket Rental is $7.50 each.
Extra Man: when a second man is required to do a pickup or delivery add $25.00 per 1/2 hour minimum 4 hours.
After Hours: shipments requiring pickup or delivery after 5:00 PM will be rated at $35.00 per 1/2 hour, minimum 2 hours.
Weekend delivery: will be subject to a minimum charge of 4 hours at $35.00 per 1/2 hour.
Excessive Waiting, Loading or Unloading time: will be charged at a rate of $20.00 per 15 minutes.
Driver Unloading: of over 6 feet of loose freight by himself will be charged at a rate of $20.00 per 15 minutes.
Power Tailgate: add $75.00 plus $0.05 per pound for U.S. points not within 500 miles of the Cdn Origin or Destination. Add $75.00 plus $0.01 per pound in Canada and U.S. points within 500 miles of the Canadian Origin or Destination.
Dangerous Goods: Any shipment containing articles governed by the current rules and regulations of IATA or Whims Hazardous Goods Regulations will be subject to an additional charge of $50.00 in Cda and $90.00 to or from the U.S.
Protective Heat or Coolant Service: Will be subject to an additional charge of 25 %. Minimum charge $50.00
By submitting this form I am authorizing Fastrek Express Inc. to obtain credit information on the company listed on the registration form I am submitting. I am an employee of the above mentioned company and have the authority to issue a credit check to Fastrek Express Inc.
